Contest Rules

1. Contest Period: The contest begins on March 4, 2024, and ends on March 31, 2024 (the “Contest Period”). Entries submitted before or after the Contest Period will not be eligible.

1. Eligibility: This contest is open to legal residents of Ontario, Canada, who are within a 50-kilometer radius of 5068 Whitelaw Road, Unit 4, RR 6, Guelph, ON, N1H 6J3, and who are at least 18 years of age at the time of entry. Entrants must be following either our Facebook page or Instagram account at time of entry in order to be eligible. Employees of Hy-Mark and their immediate family members are not eligible to participate.

1. How to Enter; To enter the contest, participants must submit a photo of their current thermostat via one of the following methods: Facebook: Comment on the designated contest post with a photo of your thermostat or send a direct message (DM) to Hy-Mark ’s Facebook page.Instagram: Tag @hymarkhomecomfort in your Instagram Story with a photo of your thermostat or send a DM to Hy-Mark ’s Instagram account. Email: Email a photo of your thermostat to info@hy-mark.ca/. Only one entry per person is allowed. Duplicate entries will be disqualified.

1. Prize; One (1) winner will receive: A free smart thermostat (brand to be specified) plus professional installation. The prize is non-transferable and cannot be exchanged for cash or other alternatives.

1. Judging Criteria: Entries will be judged based on the following criteria: The worst-looking, oldest, or most outdated thermostat. The winner will be selected by Hy-Mark ’s internal judging team, and all decisions are final.

1. Winner Selection and Notification: The winner will be selected on or around April 7, 2024, and notified via the contact information provided (email address or phone number) by April 10, 2024. If the winner does not respond within 48 hours, an alternate winner may be selected. Winners will be required to sign a waiver. By entering the contest, participants agree to be contacted by Hy-Mark for the purpose of winner notification and future promotional offers.

1. Winner Announcement:  The winner will be announced on Hy-Mark ’s social media channels (Facebook and Instagram) on April 10, 2024, with the winner’s permission. A “before and after” post will be shared once the thermostat is installed.

1. Service Area: The contest is only available to residents of Guelph, Waterloo Region & surrounding areas within a 50-kilometer radius of 5068 Whitelaw Road, Unit 4, RR 6, Guelph, ON, N1H 6J3. Proof of address may be required to claim the prize.

1. Privacy:  By entering the contest, participants consent to the use of their name, likeness, and submitted photos for promotional purposes by Hy-Mark. Personal information collected during the contest will be used solely for the purpose of administering the contest and may be used for future marketing communications unless the participant opts out.

1. General Conditions: Hy-Mark reserves the right to cancel, suspend, or modify the contest if any problem prevents the contest from running as planned. Hy-Mark is not responsible for any technical issues, including but not limited to internet or website malfunctions. Installation will be completed at the discretion of Hy-Mark.

1. Release:  By participating, entrants agree to release and hold harmless Hy-Mark and its affiliates from any liability, injury, loss, or damage of any kind arising from participation in the contest or acceptance, use, or misuse of the prize.

1. Governing Law:  This contest is governed by the laws of Ontario, Canada, and all disputes will be subject to the exclusive jurisdiction of the courts of Ontario.
